WHAT is Mediation?
Mediation is a proven effective way to resolve disputes or disagreements between parties in a more informal setting outside of the courtroom. A mediator guides the disputing parties through the mediation process to resolve the disagreement.

The GOAL of Mediation:
To reach a fair agreement that all participants can live with. The emphasis is on fairness. While the rule of law can play a part in the discussion and can serve as a reference point, the rule of law does not determine the outcome. What the parties think is fair, and what will work for them, is most important.

The BENEFITS of Mediation:
The parties stay in control of the process and the outcome. They never have to enter into an agreement that they do not think is fair.
There are no surprises about what the outcome will be. The parties know what the agreement is before they sign it because they created it.
The participants are free to end the mediation at any time
and pursue other means of resolving the dispute, including pursuing a judgment in court. However, parties lose control of the process and of the outcome once they decide to enter the courtroom. At that point, the Judge is in control and will make a decision that the parties MUST live with, regardless.
Mediation is a confidential process. What one party learns about the other party in the mediation cannot be used against her in court, if the mediation breaks down.
A setting in which confidentiality is honored frees the participants to be more open and honest with one another about underlying issues, fears and emotions in a way that would be unlikely to surface in a courtroom setting.
The mediation setting allows for the exploration of tailor-made solutions to fit the participants' unique needs and concerns.
Mediation has a high rate of success. Parties who reach a mediated agreement are more likely to honor the terms of the agreement they created.
Mediation costs less than resolving disputes in court.
